Obviously no one cared about Neely every day when they rode the train or walked by him on the street acting crazy and aggressive. Many of the Reddits showed that he had gotten increasingly aggressive over time. Nothing was done about it. Penny was put in a situation where he was forced to act and did so as a Good Samaritan. If you punish people for this, we’re cooked. If you de-incentivize men from stepping up and acting as protectors because some junkie might OD or have a heart attack and then they catch politicized felony charges, then you get what you deserve — which is societal and civilizational collapse.
I lived in Portland, Oregon for 10 years and watched it disintegrate bc of the policies and ‘restorative justice’ and woke thinking that prosecutes decent people and lets insane, the drug-addicted and criminals run free. Now they can’t even get cops to work there. It’s a disaster. Portland went from the most beautiful downtowns I have ever seen into a dystopian hellscape. Murder rate went up 1000%. Chaos. Filth. In this situation, no way he should have been charged with manslaughter or any felony.

It includes the portion from the news broad cast you shared and shows Penny releasing the hold around 30 seconds after Neely stops struggling and almost at the exact time the bystander urged caution. Additionally, Nelly can be seen moving after the hold was released. Neely was obviously a frail street person. In a perfect world, where the US government could spare $150 billion for the American people, Neely should have been in a low security facility where he could learn a trade and get the nutritional and psychological support he needed. Aside from that, what is the point of the fabrication? Don’t use a choke on a frail street person?

While I agree with you that the man was not unconscious until the 2 minute mark, at which point ALL attempts at movement stopped. Penny held the choke for an additional 60 seconds after that.
So, the point of my email was that the MAXIMUM you should choke someone is 10 seconds, or until you can confirm the loss of consciousness.
Your full video would seem to support this assertion, as a choke held for a mere 60 seconds after loss of consciousness just resulted in death.

I’m inclined to agree with your lack of sympathy… though I would argue that a death sentence is a bit severe for the crime.
